Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the UseAlibi desktop application and the usealibi.com website (together, the "Service"). By creating an account, purchasing a license, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What UseAlibi does

UseAlibi is a Windows and macOS application that sets the reported GPS location of an iPhone connected to your computer by USB cable, using the developer location service built into iOS. The simulated location applies only to a device you have physically connected, trusted, and configured, and only while it is tethered.

3. Eligibility

You must be at least 18 years old (or the age of majority where you live) to purchase or use the Service.

4. Accounts

You are responsible for your account credentials and for all activity under your account. Keep your email address current so we can reach you about your license and important changes.

UseAlibi is a developer, QA, gaming, and privacy tool for devices you own and control. You agree that you will not use the Service to:

Third-party apps have their own terms of service, and some prohibit or penalize simulated locations. You are responsible for how you use a changed location within those apps, including any consequences to your accounts in them.

7. Third-party services and consequences

UseAlibi is not responsible for any suspension, restriction, ban, data loss, account limitation, or other action taken by any third-party application, platform, website, or service arising from your use of the Service, including changed or simulated device location. You use those services at your own risk.

We rely on a small number of trusted providers to operate the Service: Stripe processes payments and acts as the merchant of record (see Section 5), and Supabase provides authentication, database, and hosting. Each processes only the limited data needed to provide these functions, as described in our Privacy Policy. We do not use advertising networks or third-party ad-tracking tools.

8. Location services disclaimer

UseAlibi changes the GPS location that a connected iPhone reports. This can affect third-party apps, emergency services, location-sharing and personal-safety features, device-finding and tracking tools, and anything else that relies on your device's location. You acknowledge and accept all risks arising from the use of simulated or altered location information, and you are solely responsible for ensuring such use is lawful and appropriate in your circumstances.

9. Intellectual property & no reproduction

The Service — including its software, source code, website, visual design, layout, feature names, copy, branding, logos, and user interface — is and remains the exclusive property of UseAlibi and its licensors, and is protected by intellectual-property laws. Your license grants you use, not ownership.

Purchasing access does not grant you any right to study, copy, or replicate the Service for competitive purposes, except where the law permits despite these restrictions. Violations may result in immediate termination without refund and all available legal remedies.

10. Copyright & DMCA

We respect the intellectual-property rights of others. If you believe content on the Service infringes your copyright, email usealibisupport@gmail.com with the subject line "Copyright Infringement" and include: (a) your electronic or physical signature; (b) identification of the copyrighted work and of the allegedly infringing material and its location on the Service; (c) your address, telephone number, and email; (d) a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and (e) a statement, made under penalty of perjury, that your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

11. Feedback

If you send us feedback, suggestions, ideas, or reports about the Service, you agree that we may use them for any purpose without restriction, credit, or compensation, and that you acquire no intellectual-property or other rights in the Service as a result. Feedback is not treated as confidential.

13. Limitation of liability & indemnification

To the maximum extent permitted by law, UseAlibi will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

You agree to indemnify and hold harmless UseAlibi and its officers, employees, and agents from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

14. Dispute resolution

Any dispute arising out of or relating to these Terms or the Service will first be addressed through good-faith negotiation. If it is not resolved within 30 days, the parties agree to attempt non-binding mediation before pursuing any other legal remedy. Nothing here prevents either party from seeking injunctive relief for intellectual-property misuse or breach of Section 9.

15. Termination

We may suspend or terminate your access immediately, without prior notice, if we reasonably believe you have violated these Terms, used the Service unlawfully, engaged in fraudulent or harmful conduct, or acted in a way that may damage the Service, its users, or our reputation. You may stop using the Service at any time. Provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability and indemnification, and dispute resolution — survive termination.

16. Affiliate program

If you join the UseAlibi affiliate program, these terms apply in addition to the rest of these Terms.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced on this page with an updated effective date, and where required, by email. Continued use after changes take effect constitutes acceptance.

18. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Nothing in these Terms limits any consumer-protection rights you may have under the law of your jurisdiction that cannot be waived by contract. If any provision is held invalid or unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force.
